1. Purpose and Scope
This Acceptable Use Policy ("AUP") sets out the rules governing use of SEVA's hosting, client portal, and related Services. It is incorporated into SEVA's Terms of Service by reference, as described in Section 8.6 of those Terms, and forms part of the binding agreement between you and SEVA.
This AUP applies to anyone who accesses or uses SEVA's Services, including hosting accounts, the client portal, and any content transmitted, stored, or made available through them. Violation of this AUP is a violation of the Terms of Service and may result in the consequences described in Section 6 (Enforcement) of this policy.
SEVA may update this AUP from time to time. Material changes will be communicated in the same manner as material changes to the Terms of Service, as described in Section 13 of those Terms.
2. Prohibited Content
You may not use SEVA's Services to host, store, transmit, or distribute content that:
- (a) is illegal under applicable law, including content that promotes or facilitates illegal activity;
- (b) infringes any copyright, trademark, trade secret, or other intellectual property right, as further addressed in Section 3.5 (Copyright Infringement Notices) of the Terms of Service;
- (c) is defamatory, harassing, threatening, or discriminatory, or constitutes hate speech;
- (d) contains malware, viruses, or other malicious code intended to damage, disrupt, or gain unauthorized access to any system;
- (e) consists of adult or sexually explicit material, gambling services, or cryptocurrency mining operations.
SEVA reserves the right to determine, in its reasonable discretion, whether content violates this Section.
3. Prohibited Conduct
In connection with your use of the Services, you may not:
- (a) attempt to gain unauthorized access to any system, account, or data, including through hacking, port scanning, vulnerability probing, or credential theft;
- (b) launch or participate in a denial-of-service attack or any activity intended to disrupt or degrade the Services for other clients;
- (c) send, or use the Services to send, unsolicited bulk email, spam, or email to any recipient list that was purchased, rented, or otherwise obtained without the recipient's consent;
- (d) engage in harassment, threats, abusive language, or hostility directed at SEVA's employees, contractors, or agents, in any communication channel.
3.1 Client Security Testing
If you wish to conduct security testing, penetration testing, or vulnerability scanning of your own Client Deliverable or hosted content, you must notify SEVA in writing before doing so. Testing conducted without prior notice may be treated as a violation of Section 3(a).
4. Hosting Resource Fair Use
Hosting resources described as "unmetered" or "unlimited" in a hosting plan description, including bandwidth and storage, are provided for normal use consistent with the purpose of the applicable plan. They are not intended for use as a general file storage, backup, archival, or file- distribution service unrelated to your hosted website.
SEVA may contact you if your resource usage is disproportionate to normal use for your plan or degrades service quality for other clients on shared infrastructure. Where usage remains disproportionate after SEVA has made reasonable efforts to work with you to resolve it, SEVA may apply the enforcement measures described in Section 6.
5. Single-Site Scope and Custom Infrastructure
Starter and Business hosting plans are provided for a single website per plan, for the account holder's own use. These plans are not intended for hosting or managing websites on behalf of your own clients or customers.
If you need to host multiple sites, manage hosting on behalf of your own clients, or otherwise require infrastructure beyond a single-site plan, this falls under SEVA's Custom Infrastructure offering, scoped and set up individually for that purpose.
6. Enforcement
6.1 Severe Violations
Violations involving illegal content, security attacks, DMCA repeat infringement, or harassment of SEVA's employees, contractors, or agents may result in immediate suspension or termination of your account, without prior notice, consistent with Section 11.1 of the Terms of Service.
6.2 Other Violations
For violations of this AUP not described in Section 6.1, SEVA will provide notice and a 15-day opportunity to cure, consistent with Section 11.1 of the Terms of Service, before suspension or termination.
6.3 Determination
SEVA determines, in its reasonable discretion, whether conduct or content violates this AUP.
7. Reporting Violations
If you believe someone is violating this AUP, report it to abuse@sevasystems.io. Include enough detail for SEVA to investigate, such as the account, website, or content involved, and the nature of the violation.
Copyright infringement claims should be submitted as described in Section 3.5 (Copyright Infringement Notices) of the Terms of Service, not through this address.
8. Relationship to the Terms of Service
This AUP is incorporated into and forms part of SEVA's Terms of Service. Capitalized terms used but not defined in this AUP have the meanings given to them in the Terms of Service.
The disclaimers, limitation of liability, indemnification, and dispute resolution provisions of the Terms of Service apply equally to any matter arising under this AUP. In the event of a conflict between this AUP and the Terms of Service, this AUP controls with respect to prohibited content and conduct, and the Terms of Service control on all other matters.
